EPA Seeks Public Comment on Proposed Amendment to Consent Decree for Allied Paper, Inc./Portage Creek/Kalamazoo River Superfund Site in Kalamazoo, Michigan

U.S. Environmental Protection Agency has begun a 30-day public comment period on a proposed amendment to the consent decree for the Allied Paper Inc./Portage Creek/Kalamazoo River Superfund site in Kalamazoo, Michigan. The amendment requires the responsible party, NCR Corp., to fund and complete the cleanup of a portion of the Kalamazoo River (known as Area 3 of Operable Unit 5) under EPA’s oversight. The cleanup will include soil and sediment remediation along the riverbank and floodplain.

The original consent decree gave NCR Corp. two options: The company could either perform the cleanup or reimburse EPA $52.5 million. NCR has decided to perform the cleanup at an estimated cost of $34 million.

The public comment period closes on Sept. 20. All comments should be addressed to the Assistant Attorney General, Environment and Natural Resources Division, and refer to United States of America and the State of Michigan v. NCR Corporation, D.J. Ref. No. 90–11–2–07912/11. Comments may be submitted:
